    By using the Just a Thought website and online therapy tool these terms of use automatically apply to you - so we recommend reading them carefully. If you don't agree with these terms, please don't use this site or the online tool.

    About Just a Thought

    The Wise Trust offer you Just a Thought for use as a healthcare worker without any fees or charges. We offer healthcare workers non-exclusive, non-transferable rights to use and refer patients to the website and tool.

    The Wise Trust may suspend, terminate or restrict your access if you breach any of these terms. We may modify, change or update the website/tool at any time, with or without notice.

    Definition of a healthcare worker

    Just a Thought defines a healthcare worker as a 'health practitioner', as defined in section (s 5) of the Health Practitioners Competence Assurance Act 2003 (HPCA Act), which means a person who is, or is deemed to be, registered with an authority as a practitioner of a particular health profession.

    The HPCA Act also sets parameters that not all health professionals are regulated under the HPCA Act. This acknowledges circumstances including some professions may have a (perceived) low-level risk of harm; may work with or under the supervision of a regulated profession or may be self-regulated.

    A health profession or profession means the practice of a profession in respect of which an authority is appointed by or under this Act. Practise a profession or practise means to perform services that fall within the description of a health profession.

    A health service means a service provided for the purpose of assessing, improving, protecting, or managing the physical or mental health of individuals or groups of individuals.

    Your obligations and clinical responsibility

    In consideration of your agreement to these terms and conditions, the Just a Thought online therapy tool may be used (at your discretion) by patients under your supervision as a healthcare worker(independently supervised patients).

    The Just a Thought online therapy tool is an unmonitored service and takes no clinical responsibility for patients prescribed to its courses.

    You must rely upon your own clinical judgement as to whether the Just a Thought courses will meet your patient/s' needs.

    By electing for your patient to be an independently supervised patient (a patient that has been prescribed a Just a Thought course by you, the referring healthcare worker), and the patient is identified as being suitable for a course through Just a Thought's online screening processes, you:

    • accept full clinical responsibility for the patient;
    • prescribe a Just a Thought course for the patient with a "prescription" code;
    • the patient must accept the relevant Just a Thought terms of use;
    • continue to hold clinical responsibility for the patient throughout the duration of their course/s;
    • remain professionally responsible for the overall health and welfare of your patient;
    • undertake supervision of the patient during the course/s with due care and skill.

    Just a Thought will inform you of your patient/s' progress, in particular their K10 scores, through your clinical dashboard on the website and via email.

    Please be aware that whilst we will attempt to communicate this information to you, you must continue to monitor the progress and mental wellbeing of all patients using Just a Thought as required under your clinical responsibilities. Do not rely on this as a sole method of monitoring and ensure further monitoring is provided during the supportive contact that you/the identified support healthcare workerprovide over the duration of courses.

    You are responsible for all unauthorised usage that occurs on your account or via the prescription pads sent to you and you must:

    • promptly notify us if there is any unauthorised usage of your account or the prescription pads sent to you;
    • maintain and update your registration information supplied by you to us to ensure it's accurate at all times; and
    • only have one active account, whether this is by use of name, email address or an alias.
    Privacy Policy

    Privacy is very important to those who use Just a Thought. We understand that, so here's our privacy policy. We've kept it separate from these T's & C's so that it is quick to find when you are on our website/tool.

    Disclaimer

    The Wise Trust does not guarantee the timeliness, completeness or performance of Just a Thought or any of its content. The online tool is not monitored or reviewed by a healthcare professional and does not include personalised follow-up, outside of the automated interactivity. We do everything we can to provide an awesome experience and tool, but we can't take responsibility for the website/tool not working properly or if you don't have access to the internet.

    Any links to other websites or reference to commercial products or services is not an endorsement or recommendation from the Wise Trust or Just a Thought.

    We will attempt to keep all information regarding resources, especially crisis contact details updated at all times. Please ensure however that patients have their local crisis contact details and know what to do if their mental health begins to deteriorate or their risk of harm to self or others increases.

    (The really legal stuff): To the extent permitted by law, the Wise Trust excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

    • copy, reproduce or modify any part of the website or tool, or our trademarks in any way
    • attempt to extract the source code of the website or tool,
    • commercialise any content, products or services in the website
    • try to translate the website into other languages or make derivative versions.

    Any unauthorised use of any trademarks, or any other intellectual property belonging to Wise Trust is strictly prohibited.

    Use and restrictions

    The information in Just a Thought has been carefully put together by healthcare workers and content experts to ensure minimal risk of harm to the user. We rely on you to provide accurate information and not deliberately provide misleading information.

    If you choose not to identify yourself, provide inaccurate or incomplete information for registration purposes, we will be unable to provide you with ongoing services and updates.

    You are responsible for protecting your Login Details.

    You agree to use the website/tool in a way that does not infringe upon the copyright, moral rights, publicity rights, privacy rights or any other right of any person, or violate any law or judicial or governmental order.

    Governing law

    This website is governed by New Zealand law, and the courts of New Zealand have exclusive jurisdiction.

    The website may not comply with laws of countries outside of New Zealand. If you access this website from another country it is your responsibility to comply with the laws of that country.

    Please don't cause any damage to Just a Thought

    It is unlawful to intentionally cause damage to this website/tool. You accept that you need to ensure that the desktop or mobile device you use to access Just a Thought is secure, and free from all forms of corruption, including viruses.

    Finally...

    We reserve the right to make changes to Just a Thought at any time and for any reason. All changes will be effective immediately upon their posting to the website. Material changes will be posted conspicuously on the Website. By accessing the website and online therapy tool following posting of changes to the Terms of Use, you agree to all such changes.

    If Just a Thought is discontinued, we reserve the right to disconnect the website and online therapy tool at any time without giving notice of termination.
